No. B76339886, registered in the Commercial Register of Las Palmas on 08/03/2019 T 2212, F 1, S 8, H GC 55259886, I/A 1.I.F. NºB76339886, registered in the Mercantile Register of Las Palmas 08/03/2019 T 2212, F 1, S 8, H GC 55259, I/A 1, distributing its products through its official distributor Coffetum S.L. and The Customer (hereinafter the Customer), relating to all transactions made through the website www.Zenith Zing.com.

2. Applicability of the general conditions of sale

2.1 Every order placed with Zenith Zing via the Internet shall be governed by these General Terms and Conditions of Sale. By placing an order, the Customer acknowledges that he/she has read, understood and accepted, without reservation, these General Terms and Conditions of Sale, and we therefore remind him/her of the advisability of reading them in detail.

2.2 Zenith Zing reserves the right to modify these General Conditions of Sale by publishing an updated version of these General Conditions of Sale on this page, which will be applicable to all orders placed after the time Zenith Zing publishes the new version of its General Conditions of Sale on the Website.

3. Orders

3.1 By placing an order through this website, the Customer places an order to purchase the products he/she has selected under these General Terms and Conditions of Sale.

3.2 Orders placed by the Customer through this website may be subject to minimum quantity limits and the same will be advised on each product that requires it.

3.3 Products are offered on this website within the limits of the quantities available. In the event that your order exceeds the stock, you will be informed immediately.

4. Order Confirmations

4.1 With the acceptance of these General Terms and Conditions of Sale, orders placed via the Internet and confirmed by Zenith Zing shall constitute a binding and fully effective contract between the parties.

4.2 Zenith Zing reserves the right to refuse orders, for reasons of force majeure or in the event of non-payment.

4.3 The information recorded by Zenith Zing constitutes absolute proof of the order and of the entire transaction. The information recorded by the payment system constitutes absolute proof of the financial transactions.

4.4 If the contracted product is not available, the Customer will be informed immediately and will be refunded the amount paid within a period of less than fourteen (14) calendar days of such communication. In the event that the product offered is not in accordance with the Client's request, the Client may cancel the order and the amount paid will be refunded within the same period of time from the date of communication.

4.5 In connection with the provisions of the previous point, Zenith Zing may offer without price increase a product of similar characteristics having the same or superior quality. In this case, the Customer may also exercise its right of withdrawal and termination under the same terms as if it were the good initially requested.

5. Pricing

5.1 The prices payable for the items ordered by the Customer are those shown on this website at the time the Customer places his order, and detailed in the order confirmation, including IGIC or any other applicable tax, shipping costs or any other. The Customer may also consult the prices of Zenith Zing products on the Zenith Zing website: marketplace.zenithzing.com.

5.2 The charge for shipping costs will be invoiced on the basis of the rates indicated on this website at the time the Customer places its order, calculated in particular according to the size of the order and the delivery method the Customer selects, the Customer being duly informed of these amounts before placing its order.

6. Delivery

6.1 All orders confirmed by Zenith Zing will be delivered to the delivery address specified by the Customer when placing their order (or, if not specified, to the collection point) and within the time period linked to the service chosen by the Customer and which will be confirmed with their order.

6.2 Deliveries of orders can only be made in the geographic areas specified on this website.

6.3 In the event that the delivery of the order could not be made due to reasons beyond Zenith Zing's control, an attempt will be made to contact the Customer again to agree on a new place and date of delivery. If delivery still could not be made, the order will be returned to Zenith Zing's warehouses, and from that moment, the full amount paid by the Customer will be refunded within fourteen (14) natural days.

6.4 For orders destined for the Canary Islands, we cannot guarantee an exact delivery period, trying at all times that it does not exceed 3 weeks.

6.5 In some countries, the customer may have to settle some specific tax in order to receive the goods.

7. Verification of the goods

7.1 We remind you that the Customer is responsible for verifying the quantity, condition and state of the goods at the time they are delivered to you.

7.2 In the event that you notice any damage to the product or that the goods are incomplete, the Customer may contact and notify Zenith Zing immediately upon delivery of your order. Once Zenith Zing has certified that the defect is due to a cause attributable to Zenith Zing, Zenith Zing will replace the goods at no additional cost.

8. Returns

8.1 In the event that you wish to withdraw from your purchase made through remote channels (telephone channel, internet or Zenith Zing app), you may do so at any time after placing your order, and up to a maximum of 14 days after receiving it. To do so, please contact us to inform us of this decision via our Zenith Zing Customer Service or through the contact form on our website. Once you have informed us of your decision to withdraw from your purchase, you have 14 days to return the products to us. The cost of returning the products will be borne by the customer who will be charged for the cost of collection from your home. Also, we will refund the money of your purchase in the original form of payment within a maximum period of 14 days from the correct receipt by us of the returned product.

8.2 Requirements and instructions for return: To make the return, the products must be in their original packaging without unsealing and must have kept the proof of purchase. The consumer will be responsible for any reduction of the market price of the returned goods. Likewise, there is no right of withdrawal for any product if the retail unit pack is damaged or tampered with. Similarly, the consumer must ensure that the goods will be returned in packaging identical or equivalent to that in which they were received, which ensures the safety and integrity of the goods being returned, otherwise we reserve the right not to accept the return. At the time of return, inside the packaging indicated above and next to the products to be returned, there must be a paper with the data of the customer who made the purchase, as well as the list of products and quantities to be returned per unit of sale.


9. Payments

Payments made by credit card will be charged to the Customer during the order process. Your credit card details will be encrypted for security reasons.

10. Legal guarantee of the products

The food products offered under the Zenith Zing brand have successfully passed all the quality controls required by applicable legislation.

11. Attention to Complaints and Claims

Zenith Zing makes available to you the mail administracion@zenithzing.com to send any request, complaint or claim. Zenith Zing is committed to respond within a maximum period of one month to such requests, complaints and claims.

12. Language

The language in which the contract between Zenith Zing and the Customer shall be concluded is Spanish.

13. Force Majeure

13.1 Zenith Zing guarantees the quality of the products purchased through its website. All rights granted to consumers and users by the laws in force are guaranteed. Zenith Zing will make every reasonable effort to comply with its obligations.

13.2 However, Zenith Zing cannot be held liable for delays or failures in delivery caused by circumstances beyond its reasonable control. Such circumstances include strikes, war, natural disasters or any other situation that may prevent the production, transportation or delivery of the products.

13.3 In the event of delays, Zenith Zing will perform its obligations as soon as reasonably possible, and reserves the right to allocate any remaining product among its Customers in a fair and reasonable manner.

15. Customer Responsibilities

15.1 The Customer undertakes to make lawful use of the services and products offered by Zenith Zing, without contravening current legislation or infringing the rights and interests of third parties.

15.2 The Customer guarantees the truthfulness and accuracy of the data provided during the purchase, avoiding causing damage to Zenith Zing as a result of their incorrectness.

15.3 The Customer undertakes to pay the price of the products purchased.

15.4 Failure to comply with any of these Conditions of Sale may result in the rejection of the order by Zenith Zing without prior notice to the Customer and without entitlement to any compensation whatsoever.

16. Applicable law and forum

16.1 These General Conditions of Sale are governed by Spanish law and any dispute or discrepancy in the interpretation or application thereof, shall be submitted to the Courts and Tribunals, if any, provided by the applicable legal rules on jurisdiction, which is attended, in the case of final consumers, the place of performance of the obligation or the consumer's domicile.

16.2 In the event that the Client is a company, both parties shall submit, expressly waiving any other jurisdiction, to the Courts and Tribunals of Las Palmas.
